Litigation and dispute resolution

• Represent clients — predominantly employers — before the People’s Courts at all levels in individual and collective labour disputes

• Appear in conciliation proceedings before Labour Conciliators and before the Labour Arbitration Council

• Handle matters involving dismissal for disciplinary cause, unilateral termination of employment contracts, damages claims, wage, bonus and allowance disputes, social insurance, non-compete and confidentiality undertakings

• Develop case strategy and draft petitions, statements of defence, written submissions, procedural filings and evidence bundles

• Present and argue cases directly at hearings

Advisory and risk prevention

• Pre-litigation advice: risk assessment, termination strategy, workforce restructuring and redundancy programmes

• Draft and review employment contracts, internal labour regulations, collective bargaining agreements and remuneration policies

• Support internal investigations (harassment, fraud, misconduct) and disciplinary procedures

• Represent clients before labour authorities, social insurance agencies and trade unions

• Conduct employment due diligence in M&A transactions

Practice development

• Contribute to legal updates, thought-leadership articles and client seminars

• Supervise and mentor legal executives and paralegals

Yêu cầu ứng viên

• Bachelor of Laws; admitted to practise in Vietnam (Lawyer’s Practising Certificate and Lawyer’s Card issued by the Vietnam Bar Federation)

• Minimum 5 years’ post-qualification experience, including at least 3 years focused on labour and employment

• Demonstrable first-chair or second-chair courtroom experience in employment matters (please indicate the number and nature of cases personally handled)

• Command of the Labour Code 2019, the Civil Procedure Code, the Law on Social Insurance and their implementing regulations

• Fluent English: IELTS 6.5 or above (or equivalent — TOEFL iBT 79, four-skill TOEIC 785, Cambridge C1 Advanced). Candidates holding a degree taught in English, or with a track record of working in English at an international firm, may be exempted from the certificate requirement. Working proficiency must be sufficient to draft legal documents and deal directly with foreign clients and expatriate management

• Rigorous legal writing and analytical skills; ability to run files independently

• Composure and resilience under the pressures of a litigation practice

PREFERRED

• Experience at an international or ranked law firm serving FDI clients

• Exposure to VIAC or international arbitration proceedings

• Experience in collective disputes, strikes, or matters involving foreign employees in Vietnam

• Published legal writing in law journals or professional publications

• LL.M. or a foreign legal qualification
